Robertson v London and North Western Railway Company
Rights of Railway Passengers.
This was an action brought by Captain Archibald Robertson, chief constable of the Hertfordshire Police, against the above-named railway company, to recover compensation for breach of contract alleged to have been committed on their part. The damages were laid at £20.
Captain Robertson stated that in the month of March last, he was about to proceed to Newcastle, and having purchased tickets for himself, his wife, child, and servant, he went to look after his luggage, which had been wheeled on to the platform. Mrs.Robertson having taken her seat, he was in the set of stepping in himself, thinking his luggage would be sent after him, but one of the porters pushed him back, and the train started.
By Mr.Clarkson, for the company - He had never complained to the railway authorities, and was not aware that it was intimated about the platform that passengers were to take car of their own luggage, and see it properly placed.
Clarkson - contended that, in point of law, no delivery of the luggage to the company's servants had been proved.
Chambers having replied.
His Honour thought the delivery of the luggage had taken place, but that the compensation sought was excessive, and gave judgment for the plaintiff, with damages £6.
