Attornies
Mr.Abbot moved for a Rule calling on Mr.Joseph Heath, to shew cause why he should not be struck off the roll of Attornies of this Court, upon an affidavit, imputing to him the gross misconduct of having obstructed the Court of Justice, by preventing a witness from appearing before a Grand Jury at Stafford, at the last Assizes, to give evidence of a certain bill of indictment preferred against a person of the name of Ford.
Rule granted to shew cause why he should not answer the matters of the affidavit

Court of Kings Bench, Westminster. Nov.7
Mr.Abbot moved the Court for a rule to shew cause why Mr.Joseph Heath, an Attorney of the Court, should not be struck off the Roll. The affidavit, he observed, stated, that some time since, a man, who had committed a felony, was given into the custody of one Ford, a Bailiff of Stamford, who let him escape, and a bill of indictment was preferred against him at the last Assizes, for a dereliction of his duty.
One Gardner, who resided at Newcastle, and was a principal witness against Ford, came from that place to go before the Grand Jury, in company with the Post-Master. The Solicitor left him in the Town Hall, and told him he was only going to the Clerk of the Indictments, and would soon be back.
During his absence, Mr.Heath came up, and advised Gardner strongly not to go before the Grand Jury, as he might criminate himself. The Postmaster gave him a contrary advice, and Mr.Heath replied, that he was an impertinent fellow, and, by his arguments persuaded Gardner to go away.
This, the Learned Counsel observed, was a prevention of the rules of Justice, and called for an answer.
Lord Ellenborough asked, whether it appeared that Heath was any way connected with Ford? If not, it could only be said, he had acted blameably.
The Court ordered that he should answer the matters of the affidavit.
